Application of Terms & Conditions
By using our Services, you agree to be bound by these Terms and Conditions incorporated by
reference herein, without any limitation or qualification.
Definitions
(a) “Light Fuels” or “we” (including its variations “our” and “us”) means Light Fuels Corporation;
(b) “Topline Group” means, collectively, LIGHT FUELS and its holding company, Top Line
Business Development Corp, and other affiliated or related companies within the Topline Group.
Representations and Warranties
You represent and warrant that all information provided in connection with the use and
participation in any of the Services of Light Fuels is true, accurate and not misleading, and will
remain true, accurate and not misleading for as long as you remain a user or customer. In the
event of any changes to the details or particulars from time to time, you shall update Light Fuels
either through telephone numbers (032) 505-6058 or email address.
Rights of Light Fuels
Light Fuels and the Topline Group may at any time, in its sole and absolute discretion, with or
without prior notice to users or customers, do any or all of the following:
(a) suspend or terminate any account or membership in any Light Fuels Services/programs,
which may result in the forfeiture of any points associated with such account or membership,
without any compensation to the user or customer;
(b) introduce, amend, restrict, suspend, terminate or make any changes to any or all of the
benefits, services, facilities and privileges in respect of or in connection with any Light Fuels
Services/program.
Indemnity
Users or customers of Light Fuels’ Services shall indemnify, defend and hold harmless Light Fuels
and each of the affiliates and related companies within the Topline Group, and their respective
directors, officers, employees, agents and contractors from and against any and all claims,
proceedings, loss, damage, costs and expenses (including legal costs on a full indemnity basis)
incurred, suffered or sustained by Light Fuels and each of the affiliates and related companies
within the Topline Group, and their respective directors, officers, employees, agents and
contractors, directly or indirectly arising from or relating to the use and participation in any of the
Services of Light Fuels.
Disclaimer
(a) General
1. To the fullest extent permitted by law, Light Fuels and each of the affiliates and related
companies within the Topline Group disclaim any liability whatsoever arising from or relating to
the use and/or participation in any Services, howsoever arising, including but not limited to, the
redemption and use of associated rewards, any breakdown or malfunction in any computer
system or equipment, any notice which is misdirected and/or lost in the post, loss of income,
profits or goodwill, as well as any other direct or indirect, incidental, consequential, exemplary,
punitive or special damages of any party including third parties howsoever arising whether in
contract, tort, negligence or otherwise.
2. To the fullest extent permitted by law, Light Fuels and each of the affiliates and related
companies within the Topline Group shall not be liable for any claim, loss, damage, cost or
expense incurred, suffered or sustained by the user or customer arising from or in connection
with:
2.1 any failure or refusal by any merchant in accepting the user’s or customer’s account
or membership in any Services involving crediting of reward points associated in any
membership programs, if any;
2.2 any loss of data and records relating to the user’s or customer’s account in any
Services;
2.3 any loss of or inability to use stored reward points in membership accounts of any
Services;
2.4 any acts, omissions, negligence or willful default on the part of the merchant;
2.5 any acts, omissions, negligence or willful default on the part of any of Light Fuels and
each of the affiliates and related companies within the Topline Group and their respective
directors, officers, employees, agents or contractors;
or
(2.6) any failure or inability of the user or customer to access their application to and/or
account in any Services;
(3) For the avoidance of doubt, termination or suspension by Light Fuels of any of its Services/
programs shall not entitle its members to any claim or compensation against Light Fuels and each
of the affiliates and related companies within the Topline Group for any and all loss or damage
suffered or incurred directly or indirectly as a result of such termination or suspension.
Limitation of Liability
To the fullest extent permitted under applicable law, in no event shall Light Fuels and each of the
affiliates and related companies within the Topline Group be liable for any compensatory,
punitive, indirect, special, incidental, or consequential damages whatsoever arising out of or in
connection with the use of, or inability to use, any Light Fuels Servives/program and/or its related
applications and accounts, even if Light Fuels or a Light Fuels authorized representative has been
advised of the possibility of such damages. Applicable law may not allow the limitation or exclusion
of liability or incidental or consequential damages, and so to that extent the above limitation or
exclusion may not apply to you. In no event shall Light Fuels and each of the affiliates and related
companies within the Topline Group’s total liability to you for all damages, losses, and causes of
action (including, but not limited to, negligence) or otherwise) exceed the amount paid by you to
Light Fuels, if any, for using any Light Fuels program and/or its related applications and accounts.
Trademarks and Intellectual Property
All trademarks, service marks, logos and trade names, and other intellectual property rights,
whether registered or unregistered, are the exclusive property of Light Fuels or each of the
affiliates and related companies within the Topline Group. You may not reproduce, download or
otherwise use any such trademarks, service marks, logos or trade names without the prior written
consent of the appropriate owner thereof.
Collection, Use and Disclosure of Personal Data
The collection, use and disclosure of the users’ or customers’ personal data will be in accordance
with the Light Fuels Privacy Policy. By applying for or participating in any Light Fuels program,
you shall be deemed to have read, understood and accepted the terms of our Privacy Policy.
